All purchases and/or transactions made on the website www.majajewels.com will be subject to these terms and conditions.

Any person or company accessing and using the website www.majajewels.com and making transactions on this Website declares to know and accept these Terms and Conditions.

In these Terms and Conditions, "Customers" will refer collectively to website visitors, potential buyers, and buyers.

1. Availability

  • All our products are made to order, we do NOT keep stock of all the items that appear available to add to the cart and process your purchase. The production of your order can take between 8 to 10 business days. If you have any questions, please contact us at:

2. Price

  • At Maja Jewels, our commitment is to offer convenience, service, and product availability every day at attractive prices, with some limited-time merchandise offers and promotional prices. The prices of our products are subject to change without prior notice. We reserve the right at any time to modify or discontinue the Service without prior notice.
  • Jewelry offered online at www.majajewels.com usually has the same price as merchandise offered in our Maja Jewels stores, although in some cases, there might be differences.

3. Photographs

  • Product photographs show the closest representation of reality in terms of size, color, texture, design details, etc. Maja Jewels makes an effort to display products as accurately as possible. However, accuracy depends, among other technical factors, on the configuration and resolution of your computer, tablet, or mobile screen.
  • In this regard, Maja Jewels cannot guarantee that the features are strictly identical to those shown in the images.

4. Handmade

  • MAJA JEWELS makes its jewelry using artisanal processes (handmade); consequently, they do not have the standardization of mass-produced and/or machine-made products; therefore, slight variations or differences in appearance may exist between one piece and another, even if they are pieces of the same reference.

5. Exchanges and returns

We always want you to be satisfied with Maja Jewels products; requests for exchanges and returns refer to cases where the customer wants to replace a purchased product with a different one.
To request exchanges and returns, you must consider the following:

  • Maja Jewels accepts exchanges up to 8 calendar days after the delivery of your order.
  • The product must be in perfect condition, must not have been used, and must have all its original tags and packaging in perfect condition. If these specifications are not met, the product will not be valid for exchange or return.
  • Products sold at a discount are NOT eligible for exchange.
  • No money refunds are given.
  • Exchanges can be made for an equal or higher value than the purchase.
  • Shipping costs must be borne by the customer unless it is an exchange due to warranty. It is important that the packaging is appropriate to the nature of the product so that it is not damaged during the transportation process.

You can request an exchange in several ways:

  • Write to us at contacto@majajewels.com indicating the reason for the exchange or return, the customer's full name and details, and in a return email, we will provide you with the instructions for the exchange process.
  • Directly bring your product(s) to one of our locations.

Once the request is received and the condition of the product is verified, MAJA JEWELS will have eight business days to inform you if your product meets the criteria established here for the product exchange, and will have a maximum of 20 business days to carry out the requested exchange.

6. Shipping Policies

Shipping times

  • For orders of products available in stock, shipping will take place within 2 to 3 business days after the purchase. For orders of products out of stock, production can take between 8 to 15 business days.
  • At Maja Jewels, we ship your products to the address you want, as long as the shipping company has coverage. Purchases through our website are only enabled for customers residing in Colombia, as we only have the possibility of making national shipments.
  • During the purchase process, you must indicate the dates on which you require your product or "Home delivery" to verify inventory availability and fulfillment capacity.
  • Shipping times begin to count from the payment confirmation, which you will know through an email that will arrive in your email with which you made the purchase.

It is important to note that:

  • If your purchase payment is confirmed Monday to Friday, the first business day is the day you receive payment confirmation, and the delivery time will start counting from that day.
  • If your purchase payment is confirmed on Saturday, Sunday, or a holiday, the delivery time will start counting from the next business day after your payment confirmation.
  • You should also keep in mind that only orders placed before 2:00 pm count as the same day; any order placed after 2:01 pm will have its official delivery time counted from the next day.

Delivery times for shipping companies

Delivery times for national shipments are established by most shipping companies as:

  • 2 to 5 business days in major cities (Cali, Bogotá, Medellín), and can take 7 business days or more for the rest of the country.
  • Deliveries cannot be made at an exact time. If you have any concerns with the product dispatch, you can contact us via WhatsApp +57 3117640294.

  • For purchases over $320,000 COP, shipping will be free.
  • Once the product is dispatched, we will send you the tracking number to the email address or WhatsApp number you provided.
  • If your purchase is less than $320,000 COP, the shipping cost will be borne by the customer.

7. Payment Processes

  • All payments made with credit and debit cards are processed on the Wompi platform. We accept the following cards: Visa, Mastercard, American Express, Diners Club International.
    PSE: debit cards, checking and savings accounts, cash: via Baloto, Efecty, Su Red.
    • For payments via bank transfer to Bancolombia, Grupo Aval, and Nequi, please contact us via WhatsApp at +57 3117640294 to confirm bank account details.
    • Payments via bank transfer must be made and certified by informing the buyer's name, order reference, and attaching an image of the payment receipt via WhatsApp at +57 3117640294. Once www.majajewels.com verifies the payment, the order will be shipped.

8. Guarantees

  • Jewelry handmade by Maja Jewels is rigorously controlled before shipping or display in physical stores.
  • The gilding and enamels or paints that complement our products are sensitive to impacts, so Maja Jewels cannot guarantee against damage caused by improper use.
  • In the event of defects in quality, manufacturing, purpose, or suitability of products purchased at Maja Jewels within the warranty period of the respective product, the Customer may use the legal guarantee in accordance with the stipulations in these Terms and Conditions.

The term of the legal guarantee will begin to run from the delivery of the product to the Customer.

  • The warranty term for products made with precious metals is lifelong solely and exclusively in relation to the veracity and authenticity of the materials offered.
  • The warranty term for Maja Jewels products is 3 months; the warranty covers manufacturing defects. In no case is a piece of jewelry considered under warranty, even within the term, when it has been subjected to misuse.

All shipping costs corresponding to warranties already approved by the Quality Department are assumed by Maja Jewels.

With the Maja Jewels quality guarantee, we commit, first and foremost, to repair the jewelry. If the product cannot be repaired, it will be replaced. If the exact product is not available, another of similar commercial value to the one paid will be provided. If the fault recurs, it will be repaired again or exchanged for a piece of equal or similar characteristics to the product that led to the warranty claim.

The warranty will not apply if the product defect results from:

  • -Force majeure or fortuitous event.
  • -The action of a third party.
  • -Improper use of the product by the customer.
  • -Failure to follow the instructions for use or maintenance indicated in this document and in the product manual.

You can request a warranty in several ways;

  • Write to us at contacto@majajewels.com explaining the problem with the product and attaching at least 4 photos showing both the defect and its general condition, as well as sending the customer's full name and details. A response to the warranty claim will be provided through the same communication channel, and depending on the case, instructions on how to proceed will be given.
  • Directly bring your product(s) to one of our locations.

The customer will receive a response to this request within a maximum of 15 business days.

Reasons not covered by warranty

  • Normal use, wear, dirt, and aging of jewelry.
  • Loss of stones, if applicable.
  • Broken or cracked crystal pieces due to misuse or impacts.
  • Natural stones with different colors and shapes, or broken stones.
  • Mishandling or natural wear that the product suffers from use or contact with external factors such as chemical elements.
  • Any damage to the jewelry as a result of misuse, lack of care, negligence, accidents, impacts, crushing, inappropriate liquids or products in normal use or operation.
  • Alterations, repairs, or additions made to the jewelry.
  • Products that have been subjected to modifications and/or repairs by third parties.
  • Damage caused by the application of cosmetic and/or cleaning products (creams, perfumes, soaps, detergents, among others), as these can stain the coatings or color applications of the jewelry.
  • Damage caused by contact with the sea, swimming pools, hot springs, etc.
  • Broken or snapped chains after 10 days of purchase.
  • Discounted products.

9. Maintenance

Maja Jewels offers its customers 1 year of free cleaning and maintenance on purchased jewelry. After this time, cleaning or maintenance will incur a cost.

Shipping and/or home delivery costs must be borne by the customer.

10. Repairs

At Maja Jewels, we want you to never abandon your jewelry, which is why we offer additional services that will allow you to keep it for many years.

At the end of the warranty, if your item is repairable, we can provide you with a repair quote. You can first send a photo of your item to our customer service explaining the damage to be repaired.
An advisor will contact you to provide a quote for the requested service.

Repairs will not be performed before acceptance and payment of the quote.

Similarly, in case of losing 1 earring or any complementary item of our Maja Jewels jewelry, Maja Jewels can remanufacture it exclusively for you.

11. Product Care

Maja Jewels, created by goldsmith and designer Paulo Zambrano and manager Vanesa Solano since 2011, has developed a unique expertise. Our jewelry is the result of meticulous artisan work by craftsmen who create each piece with their hands. However, this does not mean that the jewelry does not require the utmost care.

Our jewelry is handmade in 950 sterling silver, with applications of crystals, natural stones, natural pearls, zircons, and other precious and semi-precious stones. In some pieces, we use 24k gold plating with a lacquer coating that preserves the durability of the finish.

Complements such as chains, clasps, earring backs, and similar items are made of Italian and national 925 sterling silver.

You should keep in mind that silver is a precious metal. The loss of shine or change of color is due to a normal oxidation process that silver undergoes. However, there are certain care steps that will keep the jewelry beautiful for longer.

For the proper care and preservation of the jewelry, please follow these instructions:

  • Avoid contact with perfumes and creams or cosmetic products in general while wearing the jewelry. Corrosive agents will cause it to oxidize faster and affect the appearance of the finishes.
  • Do not expose the jewelry to water. Do not bathe with it, or use it when entering pools or the sea, and in general, places with too much humidity and highly corrosive environments.
  • Do not use it in places like saunas and Turkish baths.
  • Wear your jewelry frequently. If you are going to store it, make sure it is in a closed, dry place. Humidity accelerates the oxidation process of silver.
  • Avoid subjecting your jewelry to drops and/or impacts. The metal may deform, and if your jewelry has stones, the settings may loosen.
  • Store in a dry place and individually.
  • Store your jewelry in the fabric pouch it came with.
  • Do not expose the product to high temperatures.
  • Do not drop the products or allow them to be stepped on or hit.

Please note:

Finishes with gold plating, enamels, or paints tend to fade over time and with normal use of the jewelry. The more you care for your jewelry, the longer the finishes will last. Once these finishes have faded, it's time to have your jewelry maintained to make it look new again.

13. Our Brand

All materials, including video clips, illustrations, photographs, products, images, creatives, designs, logos, and trademarks (hereinafter, "Content") appearing on the website, are our property and are protected by law. The compilation of all website content is the exclusive property of Maja Jewels SAS.

Any other use, including reproduction, modification, distribution, transmission, republication, display, or representation of the website content, is prohibited.

The name and brand Maja Jewels, and everything related to Maja Jewels, reflected on the website, registered or not. No other company or individual may use it without the express written permission of Maja Jewels SAS.

Maja Jewels products are exclusively available on www.majajewels.com and Maja Jewels stores nationwide. We reserve the right at any time to modify product prices, discontinue services or products without prior notice.

In the event that the customer suspects being a victim of counterfeiting or imitation of our products, they must notify us of such a situation so that we can resort to the legal instances required given the improper use of our designs and brand.

PERSONAL DATA PROCESSING POLICY

Maja Jewels SAS with email contacto@majajewels.com and telephone number (57) 3117640294, will be responsible for data processing and, as such, may collect, store, and use for the following purposes:

  • PROCESSING OF CUSTOMERS' PERSONAL DATA:

The purpose of processing personal data provided by MAJA JEWELS customers is: (I) to have the personal information provided at the time of signing contracts with our customers in order to fulfill the obligations derived from them, (II) to make offers and promotions, (III) to conduct evaluations and/or surveys related to the satisfaction level of our customers in relation to the products and services we offer and provide, and (IV) to send commercial communications related to the products and services we offer and provide.

  • PROCESSING OF SUPPLIERS' PERSONAL DATA:

The purposes of processing personal data provided by MAJA JEWELS suppliers are: (I) to store and classify the information provided by suppliers for easy identification, (II) to consult, compare, and evaluate all information about the supplier stored in judicial records databases or databases of legitimately constituted authorities, whether state or private, national or foreign, or any commercial or service database that allows for a comprehensive assessment of the supplier's behavior, including inquiries on lists for the prevention and control of money laundering and terrorism financing, (III) to analyze, process, evaluate, and compare the information provided by suppliers, (IV) to send information of interest and invitations to events scheduled by MAJA JEWELS, (V) to comply with Colombian or foreign law and the orders of judicial and/or administrative authorities, (VI) to issue certifications related to the data subject's relationship with MAJA JEWELS, (VII) to provide information to inspection, surveillance, control, regulatory bodies or internal or external auditors, (IX) to make payments for services rendered or products sold by the supplier, (X) to prepare invitations to bid, (XI) to comply with all obligations arising from the contractual relationship with suppliers. 

  • PROCESSING OF FINANCIAL PERSONAL DATA:

MAJA JEWELS will process your financial personal data only when this information is necessary to carry out billing, portfolio management, collections, and payments for products and services that have been provided or supplied by MAJA JEWELS, and to send invoices either electronically, physically, or by any means agreed upon with you. 

GENERAL:

MAJA JEWELS collects your Personal Data through various information sources such as personal or work electronic messages, through the website https://majajewels.com/ or physical correspondence, from existing information in MAJA JEWELS' databases in accordance with the provisions of Article 10 of Decree 1733 of 2013, through voice messages, information archived on MAJA JEWELS' computers and electronic devices, internet access, correspondence or through any other electronic device for communications and any other technological resource. MAJA JEWELS collects your Personal Data in person from all buyers at points of sale, commercial events such as fairs, among others.

DATA SUBJECT'S RIGHTS

Your rights as a data subject are those provided for in the Constitution and Law 1581 of 2012, especially the following:

  1. a) Access free of charge the provided data that have been processed.
  2. b) Request the updating and rectification of your information concerning partial, inaccurate, incomplete, fragmented data, data that leads to error, or data whose processing is prohibited or has not been authorized.
  3. c) Request proof of the authorization granted.
  4. d) File complaints before the Superintendency of Industry and Commerce (SIC) for violations of current regulations.
  5. e) Revoke the authorization and/or request the deletion of data, unless there is a legal or contractual duty that makes it imperative to retain the information.
  6. f) Refrain from answering questions about sensitive data or data of children and adolescents.

MECHANISMS TO KNOW THE PROCESSING POLICY:

The Data Subject can access our Data Processing Policy, which is published on the website.

Any question or query regarding your Personal Data collected and processed by MAJA JEWELS will be received by our responsible staff, for which you must send a written description of your query to the email contacto@majajewels.com. The responsible person will resolve your question or query within ten (10) business days following the date the question or query is received. If it is not possible for the responsible person to respond to your claim within the mentioned term, MAJA JEWELS will inform you of the situation and explain the reason for the delay. In any circumstance, MAJA JEWELS will respond to you within five (5) business days following the expiration of the initial ten (10) business days. The consent granted by you may be revoked at any time, by prior written and signed notice addressed to MAJA JEWELS, to the aforementioned email address, in the terms established by Law. If you believe that the information contained in the MAJA JEWELS database is subject to correction, updating, or deletion, or if you believe that MAJA JEWELS is not complying with its obligations established in Law 1581 of 2012, you must file a complaint with MAJA JEWELS, which will be handled according to the procedure established in Article 15 of Law 1581 of 2012. 

Policy effective date and database expiration date 

This privacy policy became effective on April 1, 2021, and your Personal Data will remain in the MAJA JEWELS database until they fulfill the purpose for which they were collected, or until the established period of time expires when there is a legal provision.
